Health & Safety in Employment Act 1992 (section 6)
"Every employer shall take all practicable steps to ensure the
safety of employees while at work"
This is the section of the act most Companies are prosecuted under, for their failure to
comply.

"Practicable Steps" by doing Electrical Safety assessments, tests and warranting
of your electrical equipment to the appropriate standard.
INTERPRETATION OF OBLIGATIONS
Under section 6 of the Health & Safety in Employment Act 1992 it states;
"Every employer shall take all practicable steps to ensure the safety of
employees while at work"
This is the section of the act most Companies are prosecuted under, for their failure to
comply.
There are various Electrical Standards to cover safety (we all know about Electrical
Warrants for Medical Operating Theatres, Explosive Areas, Camping Grounds, Caravans and
Boats) but there is a new general standard for "In-service Inspection and Testing of
Electrical Equipment" NZS3760.
It applies to every type of enterprise.
e.g: Construction, Factories, Workshops, Offices, Retail, Wholesale, Health, Schools,
Restaurants, Hotels.
Below is an extract from the foreward of this standard. It is very specific statement
about ones obligations and what is expected.
"In service testing and inspection is necessary for the safety of persons
using the equipment and for the proper discharge of the obligations of employers and
employees, as listed in legislation covering occupational health and safety matters. This
standard specifies in-service safety testing and inspection protocols and criteria
that satisfy these obligations and provides a cost effective approach to safety without
jeopardising personnel safety or involving excessive equipment down time."
To meet your obligations under the act you have to be able to legally prove that you have
taken all practicable steps. Testing and warranting equipment to this standard is at
present the simplest and most cost effective way to ensure equipment is safe for an
employee to use.
It is important to note that an employee must still be trained and have the correct
protective safety gear, to be using equipment safely.
